Starting on 25 May 2018, provisions of the Ordinance of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) comes into life.

The primary purpose of GDPR is to strengthen the protection of personal data for natural persons. PCG Academia sp. z o.o. undertakes to follow the provisions of GDPR both in the role of personal data controller and the processor.

By following the provisions of GDPR, PCG Academia sp. z o.o.:

Ensures that the rights of data subjects are exercised:

1.1. the right to access personal data – every person has the right to inquire of PCG Academia sp. z o.o. whether their personal data is processed by the company;

1.2. the right to erasure (the right to be forgotten) – the right to erase personal data applies in cases, where there is no legal basis for processing it; when the purpose of processing expires, unless there is a legal basis for further processing, personal data is erased by PCG Academia sp. z o.o.;

1.3. the right to transfer personal data – a person whose personal data is processed by the company may request for personal data transfer; in such case, PCG Academia sp. z o.o. transfers the data on a CD, in a secured file format;

1.4. the right to restrict the processing of data – each request for restricting personal data processing is reviewed on an individual basis; if there are grounds arising from Art. 18 of GDPR, then PCG Academia sp. z o.o. shall restrict personal data processing;

1.5. the right to rectification – at any time, a person may contact PCG Academia sp. z o.o. to rectify their personal data, and relevant changes will be made by the company;

1.6. the right to object – a person whose personal data is processed automatically (including profiled data) or processed for marketing purposes may object to such processing; in such case, the data shall not be used by PCG Academia sp. z o.o. any longer.

Enters into entrustment agreements as the processor

PCG Academia sp. z o.o. is a processor in regard to personal data in the systems dedicated for Universities. Processing of this data is governed by rules set out in entrustment agreements signed between PCG Academia sp. z o.o. and the University. Entrustment agreements include provisions in accordance with Art. 28 of GDPR.

Ensures system security

Systems offered by the company ensure high security levels, meet GDPR requirements and guarantee appropriate protection of the data processed within those systems. The company introduces relevant technical and organisational measures to ensure that all the security requirements set out in GDPR are met.

Regulates transferring personal data to third countries

Third Country — a country which is not a member of the European Economic Area (EEA). This means that data transfer within the European Economic Area is subject to the same regulations as a data transfer within Poland. This principle applies to all the European Union member states, as well as those Members of the European Economic Area who are not EU members (Norway, Iceland and Liechtenstein).

Personal data processed within the systems offered by PCG Academia sp. z o.o. is not transferred to third countries. Personal data is processed within Poland.

Shares personal data when necessary

Personal data processed by PCG Academia sp. z o.o. may be shared with government entities under provisions of the law.

Does not process personal data, unless necessary

Personal data is processed for a period until the purpose for which it has been collected is accomplished, save for situations in which a longer processing period is required by the law (archiving).

Information about rights of the processed data subjects

In every case of data processing, PCG Academia sp. z o.o. adheres to their information obligations set out in Art. 13 and 14 of GDPR, respectively.

The Personal Data Protection Inspector is:
1. at PCG Academia sp. z o.o. – Mr Przemysław Zegarek, who can be contacted by an e-mail to the address: iod@pcgacademia.pl or by traditional mail at the address of the registered office of PCG Academia sp. z o.o.
2. at Blackboard International B.V. -  who can be contacted by an e-mail to the address: privacy@blackboard.com or by traditional mail at the address of the registered office of Blackboard International B.V.
3. at Inspera AS – Mr Lasse Wikmark, who can be contacted by an e-mail to the address: privacy@inspera.com or by traditional mail at the address of the registered office of Inspera AS.
Your personal data will be processed under Article 6 sect. 1 let. f) of GDPR (legally justified interest – presenting the Co-Controllers’ offer) in order to provide a reply to the message sent via contact form. PCG Academia sp. z o.o. shall additionally process the personal data for the purpose of replying to the query filed via contact form, i.e. in legally justified interest of the Controller – Article 6 sect. 1 let. f) of GDPR.
The recipients of your personal data will be entities hosting the website, entities performing maintenance of the software used by Co-Controllers, as well as entities authorised to receive personal data under provisions of the law.
Your personal data will not be provided to an international organisation, data provided in the form and processed by Inspera AS for marketing purposes may be made available to the Controller – Inspera AS, whose registered office is outside of the EU – in Norway. Norway is a safe country within the EEA. A copy of the data shared can be obtained by sending an e-mail to the following address: iod@pcgacademia.pl. Personal data will be eventually transferred via e-mail.

Personal data provided in the form and processed for the purpose of replying to the query by PCG Academia sp. z o.o. will not be transferred to a third country (i.e. a country outside of the European Economic Area).

Your personal data will be stored for marketing purposes until your objection to such processing of personal data. Data processed for the purpose of replying to a query will be stored for a period necessary for replying to the received message, and then for a period required by the law, or until the expiration of any possible claims.
Consent to processing of personal data and receiving marketing information can be withdrawn by sending an e-mail to the following address: iod@pcgacademia.pl.
In relation to the processing of your personal data, you have the following rights:

the right to access your data, the right to rectification, the right to data erasure, the right to restrict the processing of data, the right to object to processing,
the right to lodge a complaint at a supervisory authority, such as the President of the Office for the Protection of Personal Data if concluded that the Personal Data processing has breached GDPR provisions.

The provision of personal data for marketing purposes is voluntary. In case of data processing for the purpose of replying to a query, providing data marked with an asterisk is necessary for sending a message via contact form. The consequence of failing to provide your personal data is no possibility to send a message. Providing all the remaining data is voluntary and does not affect the capacity to send a message.
Processing of your personal data will not entail any decision-making, it will be based solely on automated processing, and the data shall not be profiled.
